The Federal Communications Commission's February 2024 declaratory ruling did not introduce a new law. It applied an old one — the Telephone Consumer Protection Act of 1991 — to a new technology. The effect was identical to a new law: every AI-generated outbound call to a US number is now legally treated as an "artificial or prerecorded voice" call. That single classification change rewrote the consent, disclosure, and risk arithmetic for every enterprise running an outbound dialler in North America.
Most enterprises have not adjusted. They are still operating under pre-2024 consent records, pre-2024 scripts, and pre-2024 vendor contracts. The exposure is no longer theoretical. Q1 2025 saw 507 TCPA class actions filed against US businesses, a 112% increase year-on-year, and roughly 80% of new filings now proceed as class actions rather than individual claims. With statutory damages of $500–$1,500 per call and no cap, a single 10,000-call campaign without compliant consent represents up to $15M of exposure — before legal fees.

The FCC's February 2024 ruling reclassified every AI-generated voice as "artificial" under the TCPA. This means prior express written consent is now mandatory for any AI marketing call to a US number — a standard most enterprises' existing consent records do not meet.
What the FCC's 2024 ruling actually requires of outbound AI voice
The TCPA distinguishes between calls placed using "artificial or prerecorded voice" and live agent calls. Live agent rules are looser. Artificial-voice rules are strict: prior express consent for informational calls, prior express written consent for marketing calls, plus interactive opt-out, caller ID accuracy, and DNC list scrubbing. Before February 2024, plaintiffs' lawyers and defendants argued whether an AI-generated voice was "artificial" within the statute. The FCC ended that debate. As of 8 February 2024, every voice synthesised by an AI model is artificial, full stop.
The implication runs further than most procurement teams realise. The "prior express written consent" standard is not a checkbox in your CRM. It is a signed or e-signed agreement that:
- Identifies the seller by name
- Specifically authorises calls or texts using an artificial or prerecorded voice
- Discloses that the consumer is not required to consent as a condition of purchase
- Provides a clear, conspicuous opt-out mechanism
Most enterprise CRM consent fields say something like "I agree to be contacted." That language was borderline before 2024. Post-ruling, it does not survive a class certification motion. The Finley v. Altrua Ministries case filed in April 2025 — one of the first AI-specific TCPA actions — turned on exactly this gap: alleged AI voice messages sent to a number for which the defendant had no enforceable written consent record.
The three obligations every AI voice campaign must meet
Strip the regulation back to its commercial logic and there are three operational requirements an outbound AI voice programme must satisfy on every single call. Miss any one and the call is uncompliant — and the per-call statutory damage clock starts.
- Consent capture. Documented, time-stamped, content-specific written consent that names the seller and authorises artificial-voice contact. The record must be reproducible on demand.
- Disclosure and identification. The caller's identity must be stated at the start of the call, an opt-out mechanism must be offered during the call, and caller ID must accurately reflect the calling party.
- Suppression. Internal DNC, federal DNC, state DNC, reassigned-number checks, and revocation requests must be honoured before dialling — not after.
The enterprises being sued in 2025 generally fail on requirement one, occasionally on two, and rarely on three. Consent is where the money is lost.
Why your existing consent stack probably does not pass
Three structural failures recur across the enterprises we audit before deployment. First, legacy consent fields: a tickbox on a 2019 web form does not specifically reference "artificial or prerecorded voice" and so does not meet the post-ruling written-consent standard. Second, third-party leads: purchased lists and lead-gen partners frequently cannot produce the underlying consent record on demand. The conventional read on the TCPA's identification requirement is that disclosing "this is an automated call" hurts answer rates and conversion. The data from the first eighteen months post-ruling does not support that view at the enterprise level. Calls that open with a clear human-sounding identification — "Hi, this is Maya, an automated assistant from [Company]" — sustain answer-completion rates within 5–8% of undisclosed AI calls in our deployments, and substantially outperform on opt-out compliance and complaint rates. The compliance cost is much smaller than procurement assumes; the litigation cost of skipping it is catastrophic. Treating disclosure as a feature rather than a tax is the operating posture that wins.

The vendor question every CTO should ask before signing
A voice AI vendor that markets to US enterprises but cannot produce, on demand, a per-call consent reference, an immutable transcript, and an audit-ready opt-out log is not a viable enterprise vendor in 2026. Before contracting, require the vendor to demonstrate:

UK readers operating cross-Atlantic outbound programmes should note that the TCPA's per-call statutory damages have no direct UK equivalent — PECR breaches are enforced by the ICO with monetary penalties up to £500,000 (£17.5M under UK GDPR for serious breaches), but without the per-call multiplier that makes US class actions existential.
