What HIPAA actually requires from a voice AI vendor

The HIPAA Security Rule (45 CFR Part 164, Subpart C) breaks safeguards into three categories: administrative, physical, and technical. The Privacy Rule layers on a fourth requirement that matters operationally — the Business Associate Agreement. A voice AI deployment that touches Protected Health Information (PHI) — appointment scheduling, intake, refill confirmation, insurance pre-authorisation — must satisfy all four. Most don't. The marketing word "HIPAA compliant" usually means the vendor encrypts traffic and signs a templated BAA. That is one and a half gates of four.

Before mapping the gates, the foundational test: under HIPAA, any vendor whose infrastructure accesses, processes, or transmits PHI — even transiently as part of model inference — is a business associate. There is no exception for "the audio passes through but isn't stored". The OCR position is consistent: if your voice AI hears the patient name and the procedure code, you are processing PHI, and a BAA is required. The OCR's December 2024 NPRM strengthens these requirements further by mandating evidence that identified risks have been managed and reduced over time, not just identified once and filed.

Technical safeguards — what to actually verify

Technical safeguards are codified in 45 CFR 164.312. The controls that matter for voice AI: unique user identification, automatic logoff, encryption (TLS 1.2 or higher in transit, AES-256 at rest), and audit controls under 164.312(b) — a tamper-evident log of every PHI access event. For voice AI specifically, the audit trail must record the authenticated agent identity, the operation performed (read, write, transmit), the specific PHI record accessed, the policy context, and the timestamp. A vendor that cannot produce this on demand is not HIPAA-grade — they are HIPAA-marketed.

The line that matters most is the model training clause. A voice AI vendor that retains the right to use call recordings for "service improvement" is, in OCR's reading, using PHI for a purpose beyond treatment, payment, and operations. UK health data is governed by GDPR, the Data Protection Act 2018, and NHS Digital's Data Security and Protection Toolkit (DSPT). The technical controls overlap heavily with HIPAA — encryption, access logging, retention — but the legal basis, breach reporting timelines, and data residency rules differ.
